Terms of sale.
You pay, we send the sounds, you can use them in songs you sell. The fine print below is mostly there because Stripe and our tax office want it. Nothing in here is meant to surprise you.
1. Who you are buying from
You are buying from Marchstead, a sole proprietorship based at Rua dos Remedios 41, 1100-447 Lisbon, Portugal. Our contact email for anything related to your order is info@marchstead.com.
2. What you are buying
A licence to use a digital sound pack. The download is delivered as a ZIP of WAV and MIDI files. The product page lists the exact contents of each pack before you check out.
3. The licence
When you complete payment we grant you a non-exclusive, perpetual, worldwide licence to use the sounds in audio productions of your own. This includes commercial use: music you sell, stream, sync to film or video, or release on any label.
You may not, however:
- Re-sell, re-distribute, or sub-licence the raw samples, either on their own or as part of another sample pack.
- Use the sounds to train any AI model that generates audio, without our explicit written permission.
- Share your download links with anyone else.
The licence is granted to a single person or one legal entity. If you want a multi-seat licence for a studio, write to us and we will sort it out.
4. Payment and currency
Payment is in USD via Stripe. Stripe handles the card processing and applies any 3D Secure or Strong Customer Authentication steps required by your bank or by Portuguese / EU law.
5. Delivery
Digital download links arrive by email within one minute of payment. Links remain valid for seven days. Lost links can be re-issued by replying to the email you received.
6. Refunds and right of withdrawal
We offer a goodwill 30-day refund on any pack you have not yet used in a publicly released track. See Returns for how to request one.
We are required to inform you that, under Decree-Law 24/2014, your 14-day right of withdrawal for digital content does not apply once download has begun, because you waive it at checkout.
7. Warranty and liability
We give you the sounds as they are, in working condition. We are not liable for any indirect or consequential damages arising from use of the sounds, beyond the amount you paid for the pack. Nothing here limits any non-waivable consumer right under Portuguese law.
8. Governing law
These terms are governed by the law of Portugal. Disputes that cannot be resolved by email will be heard by the courts of the district of Lisbon.
9. Changes
We may update these terms from time to time. The version that applies to your order is the one live on this page at the time you checked out.
